Suppressor Buying Experience
So you want to purchase a suppressor or NFA item. Great, we are here to help you through the process. First thing is decide are you going to own it as an individual or under a trust. I recommend a trust because it will allow more than just you to use your items and when you are no longer on this planet people you love will be legally allowed to own it. The trusts that we create take about 15 minutes and they are modifiable.
Trust FAQ
When you are ready to create your trust, all you need to bring is the drivers licenses, names and addresses of the people you want on the trust, along with beneficiaries. We simply input your info to our trust generator software, normally within a half hour you will receive your trust documents in your email. Now it's time to get it notarized. Once notarized you can scan it and email to montanacerakote@gmail.com, don't worry if you don’t have a scanner, we will scan it in for you, from there we will add it to your ATF eForm file. Don’t worry about adding any items to your trust, we will do that after your NFA item is approved via a form 4.
Now its fingerprint time!
If you are purchasing as an individual then we can process your fingerprints immediately, if you are purchasing under a trust, any person who is a Settlor of the trust or Co trustee, has to be fingerprinted, photographed, and a RPQ created.(Don’t worry we will do all this for you, and there is no cost if you purchased a suppressor or NFA item from us).
Eform Account
Only one person on the form 4 has to create eForm account(normally the settlor of the trust), if you are purchasing under the individual option, you still need to create a eForm account.
When you create the eForm account, you will need to use the same email account with the trust, the fingerprinting and the eForm account. Remember your login, email address, and your 4 digit pin.
Eform Filing
After we have completed all the fingerprinting, and passport photos of all the trust members, or an individual. We fill file all the paperwork with the ATF via a eForm 4. We at BCC, we will input all the data to the ATF, this process takes about 45 minutes, the settlor of the trust or individual will have to stick around and sign electronically. Within a few minutes of filing your form 4, you will get an email, and you can track the process via your ATF eForm account. In a hurry, we can break these steps up into different days, and your paperwork will be waiting, but remember the sooner you file the sooner your NFA item will be out of jail.
Now it's time to wait.
When the ATF approves your form 4, you will receive an email, and so will we. At this point it’s time to come back and pick up your NFA item. At this time you can add your NFA item to your trust Assignment Sheet, the settlor of the trust and two witnesses will sign the Assignment sheet. Simple discard the previous Assignment sheet, everytime you add an item to your Trust you just update the Assignment sheet. Make sure to send us a copy of your new Trust with the assignment sheet and we will update your file, so next purchase you are ready to go.
FAQ:
Trust Roles: For each name you”ll want to fill in the full legal name matching what is on their government issued ID.
- Settlor(and primary/Sole Trustee)- This is the name of the person initiating the trust.
- Co-Trustee(s)(optional)-Co Trustees must be 18 years or older, and be able to legally possess firearms. A co-trustee is someone that you would like to allow to handle/use/transport items placed in the trust. By adding co-trustees you would like to allow them to have access to the items store the items, and have the ability to add items.
- Co trustees can be added later on via our supplied DIY amendment templates, and they’ll only need to submit form 23 items, (prints/photos)when another NFA transfer takes place. No ATF notification is required.
- Successor Trustee- It is necessary to have a Successor Trustee in case the current Trustee(s) for whatever reason do not meet the requirements to possess NFA controlled items/firearms. If Co-Trustees are included, the Successor Trustee would only act if the other Trustees all became ineligible and the Settlor did not elect another Successor Trustee.
A Co-Trustee(other than the Settlor) can also be named as a Successor Trustee. Neither successor trustee nor beneficiary require signatures (unless also list as a co-trustee).
- Beneficiary- Beneficiaries are people (or organizations, etc) that you would like the items in the trust to be distributed to upon the death of the Settlor. Do not list the Settlor as a beneficiary (or successor trustee)
For first time eForm 4 transfer, the assignment sheet can be left blank and beneficiary sheet can list just a percentage and updated later on as needed.
